Ad Sabinum libri
Ex libro XXV
Dig. 1,3,3Pomponius libro vicensimo quinto ad Sabinum. Iura constitui oportet, ut dixit Theophrastus, in his, quae ἐπὶ τὸ πλεῖστον accidunt, non quae ἐκ παραλόγου.
Pomponius on Sabinus, Book XXV. Laws, as Theophrastus has stated, ought to be established with respect to matters which often occur, and not with reference to such as occur unexpectedly.
Pomponius, On Sabinus, Book XXV. Set-off is therefore necessary, because it is more to our interest not to pay, than to bring an action to recover what has been paid.
Pomponius, On Sabinus, Book XXV. If Stichus is promised to be delivered on a certain day, and dies before that day arrives, the promisor will not be liable.
