Paulus, On the Edict, Book XXV. This action is a perpetual one, for the cause derives its origin not from the time when the bad faith began, but from the date when the business was undertaken.

Paulus, On the Edict, Book XXV. If one surety maintains that the others are solvent, the exception should be granted him that he will pay, “If the others should prove insolvent.”
