Modestinus gives it as his opinion that a creditor can, by mere agreement, entirely remit or diminish the amount of interest to be due hereafter, without affecting the validity of the donation on the ground that the amount is illegal. 1It is the opinion of Modestinus that a person whose mind is affected cannot make a donation.
