De possessoria hereditatis petitione

(Concerning Possessory Actions for the Recovery of Estates.)

1Ul­pia­nus li­bro quin­to de­ci­mo ad edic­tum. Or­di­na­rium fuit post ci­vi­les ac­tio­nes he­redi­bus pro­pos­i­tas ra­tio­nem ha­be­re prae­to­rem et­iam eo­rum quos ip­se vel­ut he­redes fa­cit, hoc est eo­rum qui­bus bo­no­rum pos­ses­sio da­ta est.

1Ulpiamis, On the Edict, Book XV. It is customary for the Prætor to consider those parties whom he constitutes actual heirs; that is to say, to whom the possession of the estate is granted, after civil actions have been proposed to the heirs:

2Gaius li­bro sex­to ad edic­tum pro­vin­cia­le. Per quam he­redi­ta­tis pe­ti­tio­nem tan­tun­dem con­se­qui­tur bo­no­rum pos­ses­sor, quan­tum su­pe­rio­ri­bus ci­vi­li­bus ac­tio­ni­bus he­res con­se­qui pot­est.

2Gaius, On the Provincial Edict, Book VI. And, by means of this action for the recovery of an estate, the possessor of the property obtains just as much as an heir can obtain and secure by means of the civil actions above mentioned.
